CEI's financing was pulled, accroding to my source, because Alex and his
lawyera acted "like idiots" and "pissed off the liquidators about every other
week" and "caused months of unnecessary delays in ther resolution of the C=
technology sale" and generally "have 2-digit IQ's".
My source was arranging CEI's financing, but 10 days prior to NAB pulled it in
favor of a deal trying to aquire one peice of the technology for his opwn
company from Escom when Escom gets the nod tomorrow. At least thats what he
said…

Not all of CEI's financing was pulled, that is false. They were present at the
bid, and I beleive they are trying to work out a deal with someone else (like
ESCOM?) about something, at least this is what I heard from someone who KNOWS
Alex Amor and is keeping up on this.
Rumors that CEI lost their financing, are rumours. However, CEI did not win
the bid, nor will they probably acquire the Amiga. But I wanted to mention
this.
I certainly am _NOT_ calling you a liar. I believe you were told what you
were told. However the fact that CEI didn't even make a bid, speaks
volumes for the financing they had, or the lack thereof.
If they couldn't come up with the bucks to make a bid, how were they ever
going to be able to "start production the next day". All that flak about
having contracts ready to go, and suppliers on standby.
Bet those ready to go suppliers feel a little funny about waiting on a guy
who couldn't come up with the scratch to make even a loosing bid.
So it wasn't all pulled. Evidently what was left was cab fare.

Maybe they already made an agreement with Escom as to what would happen IF
Escom won the bid…

ESCOM BUYS COMMODORE
On April 20th, 1995 Escom's bid of $6.4 million became the bid of record for
the Auction of Commodore's remaining assets. It received a counter bid from
Dell Computers, the silent partner supporting CEI of Florida, of $7.3 million.
In addition, three objections to the auction where heard. One from IBM claimed
rights to Commodore patents under an agreement made many years ago wherein IBM
and Commodore exchanged patent rights.
On April 21, 1995, Dell computer increased its offer to $15 million, with the
contracted plans to have CEI begin managment of the Amiga Computer
manufacturing company, resulting from the purchase of the remaining Commodore
assets. Prior to lunch, the presiding judge indicated to Escom, that they could
have the winning bid if they increased their current offer of $6.4 million to a
total of $13.4 million. After lunch, Escom made the bid of $13.4 million and
was awarded the contract for the purchase of Commodore's assets.
It is believed that Escom has already made arrangements for a company based in
Beijing to purchase the manufacturing portion of the contract and leave Escom
with the German trademark and Commodore name for German marketing, the original
asset that Escom wanted.
Although the bid was supposed to go to the highest bidder, there was some
discussion as to the whether all of the patents, as listed as Commodore's
assets, where free and clear. With the possibility that any manufacturing
effort would result in continued royalty payments for those unclear patent
rights, CEI and Dell had argued for clear title to all Commodore assets.
Whether there is a possiblity of appeal, from the short changed creditors, or
whether Escom will be seeking a stateside manufacturer or distributor for the
possible Amigas, and what the Beijing company is planning to do with the Amiga,
should its rumored contract with Escom be real, is not known at this time.
This is the situation with Commodore as I know it, Friday, April 21st, 1995 at
11:41PM EST.

The following is a messaged I just received from a very close friend of mine
who is very close to the Escom deal:

Left you a voice mail message. Escom got it. Alex went in with Dell Computer
with a stupid bid. No other valid bids. My company has a Letter of Intent to do
a joint venture with Escom whereby we assemble a team of ex-Commodre/Amiga
experts to help them re-start the R&D and production and provide other services
in return for a license to use the Amiga technology in interactive set-tops
world wide. Our guys are going to Germany in about 10 days to hammer-out
details.

The voice mail said basically the same. I take this at face value. This guy
is no BSer. Another thing he mentioned a couple of weeks ago was that there
are potential patent or copyright infringements which might possibly be
litigated successfully, in particular dealing with 3DO, but he wasn't sure how
far it could be taken under the current circumstances.
I'll keep you guys posted when I hear anything more. Also noticed the delays
are down to 10 days from two weeks <g>.

I know the gentleman who was arranging the financing for Alex and I spoke to
him about the situation on 13 April. He was working with Aleix since near day
one, and when he and his team broke off the aggreement with Alex, it was
because, as he put it, both Alex and his Lawyer have 2-digit IQ's and their
constant bungling and messing with the liquidators actually delayed the final
resolution by several months. His opinions/observations, so I can't argue
them, but I've know this guy for years and he does not generally misrepresent
basic facts though his opinions about them are sometimes stated in harsh
extremes.

Having known Alex… I can say that he ought to be under Irving Gould's yacht
scraping barnacles.
