You can be sued for anything in this country, groundless or not. In fact, due to the way attorneys are paid – hourly for the defense and percentage for the plaintiff — there is too much pressure towards settlement for specious claims. The law needs to be changed so that a plaintiff is responsible for the defense costs if he does not prove his case. You lose by being sued even if you win in court!

Chris, I agree with you. Our court system needs some overhaul. It could be hard since our system is based on case history. It is still possible but how do you regulate a private practice and how they charge their fees without taking away too many rights of the attorney? Still, it needs to be done. Jerry
