FCC philosophy- The airwave (frequency spectrum) belong to the people as a limited resource, for the purpose of cummunication. RFI interfers with that process, and so is a pollution of a public resource, one the FCC is chartered to regulate. Therefore, they have the right to regulate possible sources of RFI. Their inconsistancy in doing so is neither here nor there. They do have the right, and I feel, the duty.
