Normally, the burden of proof lies with the plaintiff. However, in a
defamation action, the defendant (the alleged defamer) must plead and
prove the truth of his statements as an affirmative defense. That is, the
person being sued for defamation must prove his statements were true. The
person claiming he was defamed doesn't have to prove the statements were
false.
