If they're using their old copy of R2 to upgrade to R3, and then selling you their R2 copy, it's illegal. In addition, they will not receive a hardware lock with the upgrade, so they'll have to give you a "broken" copy of R2 which, believe me, will give you mucho subtle problems. If, on the other hand, they have a legit copy of R2 for sale, you should make sure that that includes everything required for an upgrade of your own, or you're stuck with an orphan. As far as support, R2 doesn't need appreciably more support than R3. You should be able to get support online here, but you'll almost certainly be wanting to "upgrade" in short time.
