Craig,
I'd go along with that. *BUT*, maybe you would agree that the *SYSTEM* in
this country in which the lawyers operate, which many times *COMPLETELY
DISREGARDS* the meaning of "neglegence", is partially the problem. If we
gave judges the perogative to "thow-out" jury judgements if the evidence
doesn't meet a very strict definition on what is neglegence, we may obtain
some breating room. Until that happens, both *WE* (the people) and *THEY*
(the lawyers) we continue to be too tempted by the posibility of "big
dollars". Really all you need is to show a family who has lost a loved one
to a jury and they will try to "just give them something for their loss",
even if it was mainly their stupidity or just provedence. My wife and I had
our 1st child 6 mo ago, and good OBGYN's are getting scarse due to people
suing them for that nature and sometimes their own behavoir had delt them.
Without a very clear definition of neglegence and also the empowerment of
the judiciary to enforce this standard, the carrots will still be dangling,
and the horses (both the plaintiffs and the lawyers) will find it hard time
not trying to take a bite.
