My understanding is that there is nothing _currently_ in the law that would prevent you from selling an identical copy of a font with a new name. I'd guess, however, that Bitstream and CG made slight changes so that they wouldn't be vulnerable in the likely event that the law ever changed. I've also been told by font salesmen that their cut of a font was "truer" to the original design, etc.
